Terms of Sale

The service is offered as three bundled plans: DÉCOUVERTE (Discovery), free of charge, then ESSENTIEL (Essential) and PREMIUM, which are paid. Each plan bundles modules and quotas (users, products); modules are not sold individually. Plans exist for each supported business sector (restaurant, shop); the customer only sees those of their sector. The features and quotas of each plan are presented on the site and in the application at the time of subscription.

Prices are shown in CFA francs (XOF) and are, unless otherwise stated, exclusive of tax; applicable taxes (in particular VAT) are added where relevant. The applicable prices are those displayed at the time of subscription. The publisher reserves the right to change its prices, with new prices applying to subsequent subscription periods.

An account is requested online, on the site; the request constitutes acceptance of the Terms of Use and the Privacy Policy, which are presented on the form. The account is activated by the publisher once the applicant's e-mail address has been verified. Subscribing to a paid plan, like any switch to a paid plan, constitutes acceptance of these Terms of Sale, which are available on the site; it is activated by the publisher once payment has been validated (see "Payment and invoicing"). Switching to the free DÉCOUVERTE plan involves no payment: it is requested from the publisher, in writing, and takes effect at the end of the current period, like a termination (see "Termination").

Payment is made by Mobile Money, in advance, for the chosen period (one month or one year), to the number shown in the application. The customer sends the transaction reference to the publisher, who verifies the payment and records it manually. The paid period starts at the due date of the current period or, if there is none, when the payment is recorded; the new due date is visible in the application. The subscription is concluded for the term chosen at subscription and renews for successive periods of the same duration, unless terminated by either party before the due date, under the conditions below.

The customer requests termination in writing, at [À COMPLÉTER — email de contact], from the e-mail address linked to their account. The publisher carries it out and confirms it in writing. Termination takes effect at the end of the current period; amounts already paid for that period are not refunded, unless otherwise provided. The publisher may terminate in the event of the customer's breach, in particular non-payment.

In the event of non-payment, the publisher may suspend access to the service after informing the customer, until the situation is resolved.

At the end of the contractual relationship, the customer may request the export of their data in a usable format, for a reasonable period. After this period, the data is deleted, subject to legal retention obligations (in particular tax and accounting).

The publisher's liability under the subscription is limited to the amount paid by the customer during the period concerned. The publisher is not liable for indirect damages.

These Terms of Sale are governed by Beninese law. Any dispute falls within the jurisdiction of the competent courts of Cotonou, subject to applicable mandatory provisions.
